LEVEL OF IMPLEMENTATION OF RA. 4136 IN CATANAUAN, QUEZON

Abstract
The Republic Act 4136 is also known as the “Land Transportation and Traffic Code”. The provisions of this Act shall control, as far as they applied, the registration and operation of motor vehicles and the licensing of owners, dealers, conductors, drivers, and similar matters. This study determined the perception of the respondents to RA 4136, identified the common violations committed and assessed the level of implementation and the perceived problems encountered in the implementation of the law, especially in Catanauan, Quezon. By identifying the problems, the researchers sought recommendations and solutions. The researchers used a purposive sampling design, this method simply means choosing the sample with a specific purpose or objective in mind. In this technique, the respondents are chosen based on their knowledge of the information desired. Based on the results and discussions, the following conclusions are obtained, the study showed that the respondents know that any license not renewed on or before the last working day of the month when the applicant was born shall become delinquent and invalid. Moreover, the passenger trucks may be allowed to construct any cargo-carrying device at the rear or the side of the truck, subject to the approval of the commissioners. The respondents have committed the common violations which are the load extending beyond projected width without a permit and driving without a license. The level of implementation resulted highly implemented are licensed operators of motor vehicles and any motor vehicle with a trailer having no front axle and so attached that part of the trailer rest upon motor vehicle and subs and the perceived problems encountered of the respondents in the implementation of the law are when drivers are intoxicated or driving under the influence of illegal drugs and the drivers flee the scene of the crime. The researchers recommend the following: The local government should implement free seminars for the drivers here in Catanauan to give information to the drivers and to be aware of the rules and regulations under the R.A 4136, and lower the price of seminars because of the high cost of theoretical and practical driving course is the main reason for the respondents of not having driver’s license, suggest the implementation of a program entitled “Dagdag Kaalaman Para Iwas-Aksidente” which tackles the common violations and what are the recommendations and solutions to avoid of being violators and the BLGU should strengthen the rules and regulations and add ordinance that will support the objectives to suppress the illegal activities of some drivers. The Local Government Unit should have a partnership with the TESDA/any driving schools that give free orientation and seminars and to decrease the number of violators when it comes to the drivers under the influence and alcohol and using drugs the Local Government Unit should implement longer detention and higher fines.
