Abstract

RA9344or the Juvenile Justice Welfare Act of 2006 coverthe process of the case involving juvenile or Child in conflict with the law. From preventing them, to rehabilitate them and to inform them and return to the community as a law abiding citizen. CICL refers to a child who is alleged as accused or adjudged as having committed an offense on the RA 9344. Or the Philippine laws. In the previous law of RA9344, a child fifteen (15) years of age or under and or below 18 years of age at the time of the commission of the offense shall be exempt from criminal liability unless acted with discernment. However the child will be subjected to an intervention program pursuant to Sec 20 of this act. under art. 192 of the PD 603 the child can be suspended his trial if he/she is a first offender below 15 years old, not a habitual delinquent. And must not violate the provision of the suspension trial. In the proposed amendments of RA9344. However, base on the RA 9344, in terms of prevention of the CICL, the family shall be responsible for the primary nurturing and hearing of their children to prevent them to become delinquents. As far as practicable and in accordance with the procedures of their act, a CICL shall return to the community, maintain and strengthen the relation of child his/her family. CICL is one of the major problems of our society encountered by the PNP, DSWD and especially their parents. These problems are the violent behavior of the children, rebellious act due to lack of parental interest. Children are too vulnerable in terms of experimentation and by influence of peer pressure that cause the changes of the behavior of every child.
