Manuel S. Enverga University Foundation provides faculty and non-teaching employees with a formal process to raise workplace concerns and appeal decisions affecting their employment rights and welfare.

Effective November 2025, the University’s Grievance and Appeal Process establishes procedures for fair review, written resolution and reconsideration of decisions, with safeguards for confidentiality and due process.

Coverage and access

The process covers permanent, probationary, contractual and part-time employees. Employees may raise concerns about workplace treatment, working conditions, health and safety, administrative actions, employment rights, benefits and welfare.

Concerns involving the interpretation, implementation or enforcement of the collective bargaining agreement follow the CBA Grievance Machinery and Labor-Management Council. The Human Resource Department’s internal procedure handles non-CBA concerns and complements these existing mechanisms.

Employees may also raise concerns and appeal decisions concerning pay determination or performance appraisal reviews. The Human Resource Department shall assess the concern and direct it through the appropriate internal procedure or, where it involves interpretation or implementation of the collective bargaining agreement.

Filing and resolving a grievance

Employees may initially raise a concern with their immediate head. If the matter remains unresolved or is sensitive, they may submit a Grievance Form directly to the Human Resource Department.

The department determines the appropriate forum and refers CBA-related concerns to the designated grievance machinery. For cases accepted for internal processing, it issues an acknowledgment within two working days.

Depending on the concern, the process may involve dialogue, voluntary mediation, administrative review or fact-finding. Cases involving potential misconduct may be referred to the University Disciplinary Action Committee. A written resolution is provided to the complainant and respondent.

Appealing a decision

An employee who is dissatisfied with the resolution may file an appeal within 15 working days of receiving it.

The appeal is evaluated through the designated review process involving the Human Resource Department, Vice President for Administration and, where necessary, the University President and Chief Operating Officer. The Vice President for Administration may convene an Appeals Committee, and final review may be elevated to the University President.

A final decision is issued, and the Human Resource Department securely maintains the case records. Any adjustment to procedural timeframes due to case complexity must be communicated in writing.

Confidentiality and protection against retaliation

All grievances and appeals must receive prompt, fair and confidential handling. Employees who file grievances in good faith must not be penalized, harassed or discriminated against. Retaliation is prohibited and may result in disciplinary action.

Through these procedures, MSEUF supports employee access to review and remedy, contributing to Sustainable Development Goal 8: Decent Work and Economic Growth.
