Policy on Equivalent Rights and Protection for Outsourced Workers

Policy on Equivalent Rights and Protection for Outsourced Workers

SDGSDG 8: Decent Work and Economic Growth

Manuel S. Enverga University Foundation is committed to protecting the rights, welfare and dignity of workers engaged through third-party contractors and service providers.

Through its Policy on Equivalent Rights and Protection of Workers in Outsourced Services, the University requires equivalent protection of fundamental employment rights for outsourced workers and directly employed personnel. Outsourcing shall not be used to avoid labor obligations or reduce protections against discrimination, exploitation and unsafe working conditions.

Protection across outsourced services

The policy covers workers assigned to security, janitorial, maintenance, construction and other outsourced activities. It requires contractors and service providers to uphold:

  • Fair and timely compensation, applicable benefits and required social protection contributions.

  • Safe working conditions, appropriate protective equipment and access to welfare facilities.

  • Equal treatment and protection against discrimination and harassment.

  • Freedom of association and lawful collective representation.

  • Protection against forced labor, child labor and coercion.

  • Fair working hours, rest periods and applicable leave.

  • Access to complaint procedures without retaliation.

Contractor responsibility and University oversight

Contractors must communicate workers’ rights, maintain compliance records, cooperate with University reviews and correct verified violations. These obligations also extend to authorized subcontractors.

The General Services Department monitors outsourced services under its supervision, while the Sustainability Department monitors outsourced security services. The Human Resource Department provides guidance on employment rights and coordinates the handling of worker complaints.

Monitoring includes document reviews, workplace inspections and confidential worker consultations. Contractor noncompliance may result in corrective action and contractual remedies, subject to applicable requirements.

Reporting concerns and seeking assistance

Outsourced workers may report concerns directly to the Human Resource Department or the University office supervising their assignment without obtaining prior contractor approval.

Reports shall receive prompt, impartial and confidential handling. Retaliation against workers who report concerns, participate in investigations or exercise protected rights is prohibited. University procedures do not restrict access to external assistance or complaint mechanisms.
